Terms of Service

1. Purpose

These Terms of Service define the rules for accessing and using the GradeX service, available at gradex.cards.

GradeX is an application that allows users to generate AI-assisted visual condition reports from photos of Pokémon cards provided by the user.

GradeX aims to help users present the apparent visual condition of their cards in a clearer and more structured way, in particular for sales or exchanges.

2. Nature of the service

GradeX provides a software tool for AI-assisted visual analysis.

GradeX is not:

  • an official grading service;
  • an authentication service;
  • a physical inspection service;
  • a valuation service;
  • a guarantee of condition, authenticity or market value.

Reports generated by GradeX are provided for informational purposes only and are based on the photos submitted by the user.

The user understands that GradeX does not physically handle the cards and therefore cannot verify their authenticity, full actual condition or market value.

3. User account

Access to certain GradeX features requires creating a user account.

The user agrees to provide accurate, up-to-date and complete information when creating and using their account.

The user is responsible for keeping their login credentials confidential and for all activity carried out from their account.

In case of unauthorized use of their account, the user must contact GradeX as soon as possible at:

GradeX may offer third-party login methods, including Google Sign-In. The use of these login methods may be subject to the terms of the relevant provider.

4. Use of the service

The user agrees to use GradeX fairly, for its intended purpose and in compliance with applicable laws.

In particular, it is prohibited to:

  • use GradeX to publish or share misleading, fraudulent or unlawful content;
  • upload photos that do not correspond to the relevant card;
  • intentionally use blurry, incomplete, altered or misleading photos in order to obtain an inaccurate report;
  • present a GradeX report as an official grading, official authentication or official valuation;
  • attempt to bypass the credit, payment, security or access systems;
  • disrupt the operation of the service;
  • access or attempt to access data belonging to other users;
  • use GradeX in a way that infringes the rights of third parties.

5. Photos uploaded by the user

The user is solely responsible for the photos they upload to GradeX.

The user guarantees that they have the necessary rights to upload, use and share these photos as part of the service.

The user understands that the quality of the report directly depends on the quality, clarity, accuracy and completeness of the photos provided.

Blurry, incomplete, overexposed, hidden, incorrect photos or photos that do not correspond to the relevant card may result in an inaccurate or unusable report.

GradeX may refuse, block or delete content that is clearly abusive, unlawful, fraudulent or contrary to these Terms.

6. AI-assisted analysis

GradeX reports are generated using AI-assisted analysis systems.

The user acknowledges that AI may produce imperfect, incomplete or inaccurate results, especially if the photos provided do not allow the visual condition of the card to be properly assessed.

GradeX does not guarantee that the analysis will detect all defects, marks, alterations, restorations, counterfeits or elements that may influence the actual value of a card.

The user remains responsible for how they use, interpret and share the generated reports.

7. Reports, public certificates, QR codes and PDF files

After generating a report, the user may create a shareable public certificate.

This certificate may be accessible through a unique public URL. Anyone with the link may view the certificate as long as it has not been revoked or deleted.

The public certificate may be accompanied by a QR code and a PDF file.

The user is responsible for sharing their public certificates, including when using them in a listing, a conversation with a buyer or an online publication.

GradeX may revoke or make a certificate inaccessible in case of abuse, fraud, violation of these Terms or technical or legal necessity.

8. Credits

Some GradeX features may require the use of credits.

Credits may be used to launch or generate reports according to the terms displayed on the website.

The terms relating to the purchase, price, consumption, refund and validity of credits are detailed in the Sales Terms.

9. Service availability

GradeX makes reasonable efforts to provide an accessible and functional service.

However, GradeX does not guarantee that the service will be available continuously, without interruption, error or defect.

The service may be temporarily unavailable due to maintenance, updates, security reasons, overload, technical incidents or failure of a third-party provider.

GradeX may modify, suspend or discontinue all or part of the service in order to improve its operation, ensure its security or comply with a legal obligation.

10. Account suspension or deletion

GradeX may suspend or delete a user’s access to the service in case of violation of these Terms, abusive behavior, fraud, attempt to bypass the system or risk to the security of the service.

Where reasonably possible, GradeX may contact the user to allow them to provide explanations.

Suspension or deletion of an account may result in the inability to access associated reports, credits or certificates, subject to applicable legal obligations.

11. Intellectual property

The GradeX website, interface, logo, texts, visual elements, components and more generally the elements specific to the service are protected by intellectual property law.

The user may not copy, reproduce, modify, distribute, exploit or reuse all or part of the service without prior authorization.

Photos uploaded by the user remain the property of the user or their respective rights holders.

The user grants GradeX the rights necessary to host, process, analyze, display and share photos and reports as part of the normal operation of the service.

Pokémon is a trademark owned by its respective rights holders. GradeX is not affiliated with, associated with, authorized, endorsed or sponsored by The Pokémon Company, Nintendo, Game Freak or Creatures Inc.

12. Liability

GradeX provides a tool to assist with visual analysis and presentation of an apparent condition.

GradeX cannot be held liable for:

  • poor quality or inaccuracy of photos uploaded by the user;
  • misinterpretation of the report by the user or a third party;
  • a sale, purchase, exchange or dispute between the user and a buyer;
  • a difference between the GradeX report and the opinion of a professional, grading company or buyer;
  • loss of opportunity, loss of sale, price decrease or commercial dispute;
  • temporary unavailability of the service;
  • an incident caused by a third-party provider necessary for the operation of the service.

The user acknowledges that GradeX does not replace a physical inspection, professional expertise, official grading or authentication.

13. Personal data

Personal data processing carried out as part of GradeX is described in the Privacy Policy.

The user is invited to consult it to understand what data is collected, why it is used, how long it is retained and how to exercise their rights.

14. Changes to the Terms

GradeX may update these Terms of Service to reflect changes to the service, regulations or features.

The applicable version is the one available on the website on the date the service is used.

In case of significant changes, GradeX may inform users by any appropriate means.

15. Governing law and disputes

These Terms are governed by French law.

In case of question or complaint, the user is invited to contact GradeX at:

In case of dispute, the parties will attempt to find an amicable solution before taking any legal action.
